These Terms of Service ("Terms") govern your use of the CalmBuddy mobile application ("CalmBuddy," "the App," "we," "our," or "us"). By downloading, installing, or using CalmBuddy, you agree to these Terms. If you do not agree, please do not use the App.

1. Acceptance of Terms

By accessing or using CalmBuddy, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference.

2. Description of Service

CalmBuddy is a personal wellness companion app offering:

• Mood Logging - record mood type, intensity (1–10), and optional notes
• History - review past mood logs and notes
• Insights - charts and summaries of your logged moods over time
• Wellness Tools - guided breathing exercises, a private journal, mood-related prompts, and Premium SoundScape
• Premium SoundScape - unlocked by watching a short rewarded ad; no subscription, payment, or account is required to access it
• Settings - daily reminders, a Privacy PIN lock, and the ability to erase all locally stored data

CalmBuddy operates primarily offline, storing your data locally on your device as described in our Privacy Policy.

3. Eligibility

You must be at least 13 years old (or the minimum digital consent age in your country) to use CalmBuddy. If you are under the age of majority in your jurisdiction, you should use the App only with the involvement of a parent or guardian.

4. License to Use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use CalmBuddy on devices you own or control, solely for your personal, non-commercial use. You may not reverse-engineer, decompile, resell, sublicense, or create derivative works from the App except where permitted by applicable law.

5. Your Responsibilities

When using CalmBuddy, you agree that you will:

• Use the App only for lawful, personal wellness purposes
• Keep your device and any Privacy PIN secure, since journal and mood data is stored locally and protected only by the safeguards on your own device
• Not attempt to tamper with, exploit, or interfere with the App's security or functionality
• Not misuse the App to harass, harm, or impersonate others

6. Wellness Disclaimer - Not Medical Advice

• CalmBuddy does not diagnose, treat, cure, or prevent any medical or mental health condition.
• Content in the App is not a substitute for professional medical, psychological, or psychiatric advice, diagnosis, or treatment.
• Always seek the advice of a qualified physician, therapist, or other licensed professional with any questions about a medical or mental health condition.
• If you are experiencing a crisis, having thoughts of self-harm, or facing a medical emergency, stop using the App and contact your local emergency services or a crisis helpline immediately.

7. Your Journal & Mood Content

Any mood logs, notes, or journal entries you create ("Your Content") belong to you. We do not claim ownership over Your Content. Because Your Content is stored locally on your device, you are solely responsible for backing it up if you wish to retain it before uninstalling the App, switching devices, or using the "Erase All Data" feature, any of which may permanently remove it.

8. Intellectual Property

The CalmBuddy name, logo, app design, illustrations, breathing-exercise animations, prompt libraries, and Premium SoundScape audio are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. Except for the limited license granted in Section 4, nothing in these Terms transfers any ownership rights to you.

9. Privacy

Your use of CalmBuddy is also governed by our Privacy Policy, which explains that mood logs, notes, and journal entries are stored locally on your device, with no account, cloud sync, or tracking. Please review it to understand our practices.

10. Disclaimers

CalmBuddy is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that any wellness outcome (such as reduced stress or improved mood) is guaranteed.

11. Limitation of Liability

To the fullest extent permitted by applicable law, CalmBuddy and its developers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of, or inability to use, the App - including data loss resulting from uninstalling the App or using "Erase All Data." Our total liability for any claim relating to the App will not exceed the amount you paid us, if any, in the twelve months preceding the claim.

12. Termination

You may stop using CalmBuddy at any time by uninstalling the App. We may suspend or terminate your access to the App if you violate these Terms or use the App in a way that could cause harm to us, other users, or third parties. Sections of these Terms that by their nature should survive termination (such as Intellectual Property, Disclaimers, and Limitation of Liability) will continue to apply.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you within the App. Continued use of CalmBuddy after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of India, without regard to its conflict-of-law principles, unless otherwise required by mandatory consumer protection law in your place of residence.
